Safeguarding the Civil Justice System

TLPJ is safeguarding the civil justice system by working to preserve victims' rights and access to justice:

TLPJ's federal preemption litigation challenges the claims of manufacturers of dangerous autos, medical devices, pesticides, and other products that mere compliance with minimum federal safety regulations immunizes them from suit.

Our Class Action Abuse Prevention Project is dedicated to monitoring, exposing, and fighting class action abuse nationwide.

All across the country, we are combating corporate and government efforts to avoid accountability, limit punitive damages that deny the right to a jury trial, and change the federal rules that decrease victims' access to justice.

Through Project ACCESS, our national campaign against secrecy in the courts, TLPJ fights for the public's right to know. In Oberg v. Honda, for example, TLPJ unsealed critical documents exposing the dangers of three-wheel all-terrain vehicles.

Upholding Civil Rights and Liberties

TLPJ's civil rights and liberties litigation is fighting for victims of abuse and discrimination:

In Domingo v. Marcos, TLPJ held former Philippine President Ferdinand Marcos and his wife liable for the murder of two anti-Marcos trade union leaders -- the first verdict holding a world leader liable for criminal actions of a foreign intelligence service operating in the U.S.

TLPJ has successfully battled sex discrimination and used Title IX to preserve women's sports teams at Brown University and eight other universities across the country, establishing new law to safeguard women's rights.

In Botello v. Las Vegas Medical Center, TLPJ won a unique settlement providing supportive living environments and proper treatment for patients with both mental illness and developmental disabilities.

TLPJ's unprecedented Fair Housing Act suit, Lebens v. Country Creek Association, ensured a pesticide-free living space for a woman disabled by multiple chemical sensitivity.

In Cureton v. NCAA, TLPJ is challenging the misuse of test score requirements that discriminate against African-American student-athletes.

Protecting Consumers' Rights

TLPJ's consumer rights' litigation is holding unscrupulous businesses and manufacturers of unsafe products accountable:

In Chisolm v. Charlie Falk's Auto Wholesale, Inc., TLPJ won justice for Virginia low-income consumers victimized by a used auto dealership that engaged in a fraudulent car repossession scheme.

TLPJ created a new model for consumer class action settlements in Cox v. Shell Oil Company, winning unprecedented relief for millions of property owners victimized by defective polybutylene plumbing systems.

In Brogan v. Kimberly Services, Inc., the first successful lawsuit against a private AIDS-testing clinic for a false positive HIV report, TLPJ won compensation for the victim, reformed the company's testing procedures, and focused public attention on notification policies nationwide.

Our Airbag Litigation Project helps automobile crash victims and their lawyers bring product liability lawsuits against auto manufacturers for injuries caused by the manufacturers' refusal to install airbags years ago.

Preserving the Environment

TLPJ's environmental litigation is holding polluters accountable across the country:

Our Environmental Enforcement Project uses the citizen suit provisions of the nation's environmental laws to make dangerous polluters comply with the law and pay for breaking it. The project has won precedent-setting victories nationwide, including the largest Clean Water Act citizen suit settlements in Arkansas, Oklahoma,Tennessee, and Puerto Rico.

TLPJ's Exxon Valdez litigation sought to hold Exxon and the Alaska Pipeline Company fully responsible for the environmental damage caused by the disastrous Prince William Sound oil spill. The suit helped to document the full extent of the spill's effects and prompted a significant increase in the government's recovery for environmental damage.

When the U.S. Environmental Protection Agency refused to release an internal report critical of its own lax clean water enforcement record, TLPJ sued and forced the agency to make its report public.

Preventing Toxic Injuries

TLPJ's toxic tort litigation is winning justice for victims of radiation, dangerous chemicals, and other hazards:

In one of our first cases, Anderson v. W.R. Grace, TLPJ developed new techniques for proving toxic torts and won compensation for the families of eight children who died from leukemia caused by toxic wastes dumped in Woburn, Massachusetts.

Through New York City v. Lead Industries Association, TLPJ seeks to make the industry take full financial responsibility for removing lead paint and its dangers from New York City's housing.

Working with the National Coalition Against the Misuse of Pesticides, TLPJ established the Chlordane/Heptachlor Litigation Clearinghouse to help victims of these two deadly pesticides obtain full compensation -- and successfully pressured the manufacturers to remove these chemicals from the market.

In two ground-breaking suits, Bullock v. Northeast Utilities and Walston v. Northeast Utilities, TLPJ is seeking damages for victims of electromagnetic radiation emitted from high tension power lines.

Defending Workers' Rights

TLPJ's worker protection litigation is defending the right to a safe workplace and just working conditions:

TLPJ won an unprecedented class action victory for over 800 migrant workers lured to Washington by false promises of plentiful jobs and immigration assistance in Buenrostro v. Washington State Apple Advertising Commission.

In Atchinson v. Brown & Root, TLPJ reached a milestone settlement on behalf of seven workers fired for reporting dangerous safety violations at Texas' Comanche Peak nuclear power plant.

In a landmark victory for workers' rights and public health, TLPJ's Strom v. Boeing won extensive damages for leukemia victim Robert Strom and medical monitoring for over 700 of his co-workers who were unwittingly exposed to electromagnetic pulse radiation as part of a secret experiment by the aerospace company.

Two ongoing TLPJ cases, Guzman v. Amvac Chemical Corporation and Phillips v. Knotts, seek to hold manufacturers and sprayers accountable for pesticide poisoning of farmworkers.
